For Employers
As an employer, you have a legal obligation to provide your employees and stakeholders with a confidential and secure facility to allow them to raise concerns regarding potential wrongdoing within your company, your customers and suppliers.
For those employers based within the United Kingdom, this obligation falls under the scope of domestic United Kingdom Employment Rights Act legislation, details of which can be found here.
For employers based or with operations within European Union states, this obligation falls under the scope of Directive (EU) 2019/1937 of the European Parliament. All employers will be obliged to provide safe reporting channels and procedures, and protection will cover not only employees, but other stakeholders such as job applicants, ex-employees, journalists and individuals who support the original whistleblower.
For companies with at least 250 workers, the Directive applied from 17 December 2021 and for employers with between 50 and 249 employees, the Directive will apply from 17 December 2023. With this deadline approaching, employers are advised to start preparing for the implementation of the Directive now.
